The meeting was called to order at 7:00 p.m.
2. APPROVAL OF MINUTES
MOVED by Councillors Sarto and McInroy that the minutes of the April 17, 1997 meeting be approved as circulated. MOTION PUT AND PASSED.
3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Additions
1. Councillor Cooper requested "Councillor representation on Planning Advisory Committee" be added to the agenda
2. Councillor Sarto requested "Kelly Drive and Woodlawn Road" be added to the agenda
MOVED by Councillors McInroy and Schofield that the Order of Business, as amended, be approved. MOTION PUT AND PASSED.

7. CONSIDERATION OF DEFERRED BUSINESS
7.1 DA/CHW-07-96-04 - Application by Lees Development Ltd to enter into a Development Agreement to allow for commercial driveway access to Hugh Allen Drive from Civic No. 959 Cole Harbour Road
Mr. Stephen Smith, Planner, with the aid of overheads, presented the supplementary report. It addressed the following concerns:
In response to Councillor Sarto, Community Council was advised the raised island would be 4-6 inches in depth.
Councillor Schofield suggested there be a marked walkway from the parking lot to the bank.
Councillor McInroy expressed concern with cars exiting onto Cole Harbour Road, ignoring the raised median and making a left turn.
MOVED by Councillors Cunningham and Sarto that the Harbour East Community Council approve the development agreement, as revised and require the agreement be signed within 120 days, from the date of final approval by Harbour East Community Council and any other bodies as necessary, whichever approval is later including applicable appeal periods. Otherwise this approval will be void and obligations arising hereunder shall be at an end.
Without a vote being taken, the following motion was placed on the floor for consideration:
MOVED by Councillors Cooper and McInroy that Community Council allow members of the public to comment on the supplementary report. MOTION PUT AND PASSED.
Ms. Shirley Stewart stated the residents of the subdivision did not want any access onto Hugh Allen Drive and expressed concerns with the timing of the lights at the corner of Hugh Allen Drive and Cole Harbour Road.
Mr. Alan Ross stated he is opposed to the driveway as proposed and expressed concerns with left hand turning from Cole Harbour Road onto Hugh Allen Drive.
Ms. Marie Findlay, Leacock Court, expressed concerns regarding pedestrian safety at the corner of Hugh Allen Drive and Cole Harbour Road.
Councillor McInroy requested directional arrows, indicating right turn only, be placed at the exit.
Ms. Joan Boyd expressed concern with the driveway being two way.
Councillor Cooper noted that the intention was for businesses under the C-2 zone to access only Cole Harbour Road, Cumberland Drive and Forest Hills Drive. He stated this proposal will result in enhancing the danger to the residents and traffic in the area and was not in favour of the application as proposed.
MOVED by Councillors Cooper and McInroy that the development agreement be amended to provide that the driveway be exit only.
Councillor Schofield noted that if the amendment passed the residents of Hugh Allen Drive would have to access the bank from Cole Harbour Road.
Councillor Sarto said the amendment would create a safety hazard.
MOTION PUT AND DEFEATED
The vote was then taken on the main motion.

9.1 Presentation

After deliberation by Community Council, the following motion was put on the floor for consideration:
MOVED by Councillor Cunningham and Deputy Mayor Greenough that the issue be forwarded to the Dangerous and Unsightly Committee. MOTION PUT AND PASSED.
10. REPORTS
10.1 PA-DAR/CHW-01-97 - Application on behalf of Irving Oil Limited to amend the boundary line between the Municipal Planning Strategies for Dartmouth and Cole Harbour/Westphal for the purpose of extending the Highway Commercial Designation and C-4 (Highway Commercial) zone over the property at 540 Main Street
MOVED by Deputy Mayor Greenough and Councillor Sarto that the Harbour East Community Council and the Cole Harbour/Westphal - Eastern Passage/Cow Bay Planning Advisory Committee hold a joint Public Meeting for this request on May 15, 1997 at 7:30 p.m. MOTION PUT AND PASSED.

12. ADDED ITEMS
12.1 Councillor Representation on Planning Advisory Committee
MOVED by Councillors Schofield and Cunningham that Councillors Cooper and McInroy be appointed as representatives of the Harbour East Community Council on the Harbour East Planning Advisory Committee. MOTION PUT AND PASSED.
12.2 Kelly Drive and Woodlawn Road
Councillor Sarto advised left hand turning is not permitted on Kelly Drive and Woodlawn Road between the hours of 8:00 a.m. and 4:00 p.m. because of the Woodlawn School. He requested these signs be taken down to allow traffic to move right at the appropriate time.
Councillor Sarto referenced the Woodlawn Medical Centre and advised cars are turning off the property onto Kelly Drive which poses a potential traffic hazard.
Mr. Connors, Traffic Planning, advised he would address these issues.
13. NOTICES OF MOTION
13.1 Councillor McInroy
Take notice that at the next regular meeting of the Harbour East Community Council to be held on May 15, 1997 I intend to introduce a motion to seek the support of the Harbour East Community Council in recommending to Regional Council that the name "Cole Harbour Road" will not change for that section of road between Caldwell Road and Ross Road.
14. PUBLIC PARTICIPATION
Mr. Bill Stratton received clarification as to the status of requests made by the Cole Harbour Kiwanis. He further noted a portion of the Cow Bay River flows to the side of the road and expressed concerns with lack of signage denoting this. He also expressed concerns with regards to a siltation problem being created by the storm sewer drainage.
As the result of a request by Mr. Stratton, Councillor Cooper advised he would put forward a request to have Forest Hills Drive officially named and recognized as Forest Hills Parkway.
Ms. Marie Findlay expressed concerns with the possibility of the closure of the Dartmouth YMCA, the movement of the ambulance service out of Cole Harbour Fire and transit scheduling.
Councillor Cooper advised he would meet with Ms. Findlay to address her concerns.
Mr. John Harlow stated there are traffic concerns with respect to the #7 Highway and the need for a left turn arrow into Montague Road during peak traffic hours. He noted the sewer study for Cole Harbour and received clarification that all records from previous studies were available to the consultants for use in preparing the report. He suggest a Community Council newsletter be considered.
Mr. Bill Stratton asked where the portable pump originally located at the Cole Harbour Station had been moved to.
Mr. Jack Thomas noted there is indication that Sobeys will be developing property in the vicinity of the #7 Highway and the Forest Hills Parkway.
15. ITEMS FOR NEXT AGENDA
Councillor Schofield requested a staff report on the apartment building that burned on Jackson Road noting that it is still vacant, has not been repaired and the garbage that was thrown out the night of the fire is still laying around the building.
16. NEXT MEETING
The next meeting is scheduled for Thursday, May 15, 1997 at 7:00 p.m. in the Helen Creighton Room of the Dartmouth Regional Library.
