The meeting was called to order at 7:00 p.m. with an invocation.

2. APPROVAL OF MINUTES

MOVED by Councillors Cooper and McInroy that the minutes of the May 15, 1997 meeting be approved as circulated. MOTION PUT AND PASSED.

10. REPORTS

10.1 MPS Amendment: Development Boundary Extension, Waverley Road, Dartmouth

Mr. Roger Wells, Planner, presented the staff report advising this is a housekeeping item. He advised there was an oversight in the early 1980's whereby services were extended 350 feet along Waverley Road north of Lake Charles Drive and for some reason the line on the MPS map was not changed to reflect this. He stated no new homes have been built since 1983.

MOVED by Deputy Mayor Greenough and Councillor Cooper that the Harbour East Community Council approve an amendment to the Dartmouth Municipal Planning Strategy (Attachment 1) which extends the development boundary along Waverley Road to include properties presently serviced by the sanitary sewer system at a public hearing on August 19, 1997. MOTION PUT AND PASSED.

12. ADDED ITEMS

12.1 Area Rates - Deputy Mayor Greenough

Deputy Mayor Greenough, on behalf of Councillor Cunningham, requested that a staff report be requested on area rate costs for sidewalk snow plowing and local improvement charges for those districts within the former City of Dartmouth.

Councillor Sarto requested the report also include a breakdown of area rate costs on a district basis, former City of Dartmouth districts, and all districts covered under the Harbour East Community Council.

Councillor McInroy requested the report also include information advising to which streets this would not apply.

Councillor Cooper requested that this information be provided for Halifax Regional Council on Tuesday. It was noted that Council had been advised that HRM would be responsible for plowing of collector streets and requested that clarification be sought as to which streets are collector streets.

12.2 Rainbow Haven - Councillor Cooper

Councillor Cooper requested that the information item regarding Eastern Halifax County Crime Prevention Association's request for a project of public transportation to Rainbow Haven Provincial Park be brought forward to the main agenda.

MOVED by Councillors McInroy and Cooper that Harbour East Community Council endorse the service subject to the availability of funds. MOTION PUT AND PASSED.

12.3 Dartmouth Storefront Office - Councillor Schofield

Councillor Schofield advised he had received a call from a resident who had been unable to obtain information on a particular lot in Dartmouth. He stated the resident had been informed the requested information was available at the Dutch Village Road office.

Mr. Wells advised that engineering plans and information is available at Dutch Village Road.

Councillor Hetherington suggested Councillor Schofield have the resident contact the planning department.

Councillor Schofield received confirmation that an application had been received from Petro Canada for a new gas bar/convenience store for the corner of Victoria Road and Albro Lake Road. Mr. Wells noted the drawings indicate a drive through window but there has been no clarification as to what it is for.

Councillor Schofield stated the Municipality needs to ensure that there is land dedication from Petro Canada to ensure there is a sidewalk on Victoria Road and up Albro Lake Road.

12.4 Lot Consolidation Problem - 33 Foot Lots (Dartmouth) - Councillor Bruce Hetherington

Councillor Hetherington stated there are people in some of the former City of Dartmouth areas where people have two 33 foot lots together and if they want to make an addition such as a veranda or garage extension and are being told by planning services that this is not possible without a lot consolidation. He noted that a lot consolidation can cost up to $5,000. He noted all that this consolidation would be doing is erasing out the centre line on a square and advised people are willing to sign an affidavit stating they are consolidating their lots. He said what he is asking is that if staff cannot come up with an agreement on this, that staff come back to propose a proper by-law change that would allow these small lots to have that centre line erased without the expense of having them surveyed. He advised Municipal Affairs have advised they would sign it off if HRM can come up with an agreement.

MOVED by Councillors Cooper and McInroy that staff, in conjunction with the legal department, be requested to investigate the consolidation of 33 foot lots in the former City of Dartmouth. MOTION PUT AND PASSED

12.5 DND Lands - Councillor Schofield

Councillor Schofield updated Community Council on the status of the DND lands and requested and subsequent information be forwarded to Council as soon as it is received.

12.6 Summer Meeting Schedule

MOVED by Councillor Cooper and Deputy Mayor Greenough that the August 7, 1997 meeting be cancelled. MOTION PUT AND PASSED.
