Appeal Of Cheever Decision

(Thursday, August 25, 2005) - A news article and the editorial in the August, 25, 2005 Daily News was critical of the decision of HRM to appeal the decision of Mr. Justice Moir in the Cheever’s case.


HRM would like to clarify that pursuant to the terms of HRM’s insurance policy, the carriage of this case is in the hands of the municipality’s insurance company; and therefore, the decision to appeal lies with the insurance company and not HRM. HRM’s exposure will be fixed at its deductable of $100,000 regardless of the outcome of the appeal and no further costs will accrue to the municipality or its taxpayers as a result of it, whether the original decision is upheld or overturned.
