The meeting was called to order at 7:00 p.m. with an invocation.

9.1 Delegations

Councillor Hetherington introduced Mr. Mike Willett and Mr. Dick Miller advising they were in attendance to provide a brief overview of Clayton Developments Ltd.

Mr. Mike Willett circulated an introductory outline of the Company and specific projects it has undertaken to date.

10. REPORTS

10.1 PA-DAR/CHW-03-97 - Application by Clayton Development Ltd to amend the municipal planning strategies for Dartmouth and Cole/Westphal to create a residential CDD for approximately 270 acres of land on the east side of Morris Lake

Councillor Hetherington recognized Mr. Ray DeRoche and Mr. Jack Thomas, members of the Harbour East Planning Advisory Committee.

Mr. Kurt Pyle, Planner, presented the staff report, advising the amendments proposed in the plan originated from a request by Clayton Development Ltd to have 270 acres of land, located on the east side of Morris Lake, to be rezoned Comprehensive Development District (CDD) and to be located within a municipal service boundary. He stated this is to allow for the creation of a mixed urban residential development. He stated the report before Council focuses on the rezoning and redesignation of those lands. He stated staff is recommending that, if the development proceeds, it proceed in one plan area; either in Dartmouth or Cole Harbour to ensure the CDD process is operated properly. He advised in order to do this the planning strategy for both Cole Harbour and Dartmouth would have to be amended.

Deputy Mayor Greenough asked, if this development fed into the Cole Harbour catchment area would the necessity for a second pumping station be eliminated if upgrades were made to the Eastern Passage treatment plant. Mr. Pyle stated if these lands were going to be included in the Cole Harbour catchment area there would be a need for a pumping station as well as expansion to the treatment plant. He stating in order to avoid expansion to the treatment plant the municipality would have to take undeveloped lands out of the Cole Harbour service boundary.

Deputy Mayor Greenough advised he is not in agreement with small lot development.

In response to Deputy Mayor Greenough, Mr. Wells advised land would be reserve for the development of a connector road.

Councillor Schofield stated he would prefer any development comprise of a mixture of small and large lot development. He referenced the extraction of sewage from the development and noted it would be more practical to use the Cole Harbour catchment area and expand the treatment plant rather than pump raw sewage into the harbour. The Councillor expressed concern with the proposed number of units going into the Dartmouth serviced area to flow into the harbour.

In response to Councillor Cunningham, Mr. Pyle advised a buffer between the development and the lake will have to be negotiated with the developer. The Councillor suggested the Lakes Advisory Board be involved in the process as soon as possible.

Councillor Cooper asked what amount of sewage capacity would be freed up, in the Cole Harbour/Westphal area, if it was directed to the Dartmouth catchment area. In response, Mr. Pyle advised it would free up approximately 40 acres based on a load allowance of 70 gallons per day per person allowing for 18 persons per acre.

Councillor Cooper suggested the report be amended to show that, if directed to the Dartmouth catchment area, raw sewage would be going into the harbour.

Councillor Cooper referenced the Go Plan and stated the residents of the community would look unfavourably at anything that would have an impact on Caldwell Road traffic patterns. The Councillor stated that before the public participation sessions are held, lot sizes should be addressed.

Mr. Pyle advised lot sizes would be based on which sewage system the development would be feeding into. He stated, at this time, there are a number of unknown factors which will have to be addressed before final decision is made.

MOVED by Deputy Mayor Greenough and Councillor Cunningham that staff initiate a process for:

i) amendments to the Dartmouth and Cole Harbour/Westphal Municipal Planning Strategies (MPS) for the purpose of designating the 270 acres of land owned by Clayton Developments Ltd on the East Side Morris Lake to Residential and rezoning the lands to CDD Zone;

ii) inclusion of Clayton's lands within the Dartmouth Service Boundary; and

iii) review of the CDD plan policies within the Dartmouth Planning Strategy to address the impact of development on watercourses and watersheds.

MOTION PUT AND PASSED.

10.2 Completion of Eastern Passage/Cow Bay Municipal Planning Strategy Policy Review Process

Mr. Wells, Planner, advised that at the Harbour East Planning Advisory Committee meeting held on August 13, 1997, the PAC was not prepared, at that time, to make a recommendation on the overall document and the draft was referred back to the Community Review Committee with instructions to take it to a general public meeting. Subsequent to that meeting, the Committee met and a public meeting and open house is scheduled for Thursday, August 28, 1997 at the Eastern Passage Fire Hall. Following this meeting, the Citizens Committee will meet to address comments and concerns before finalizing the document.

Community Council requested that the meeting be widely publicized and information be provided to the communities of Eastern Passage and Cow Bay.

12.1 Harbour East Planning Advisory Committee Terms of Reference

MOVED by Councillors Cooper and Cunningham that the Harbour East Planning Advisory Committee Terms of Reference be approved as circulated. MOTION PUT AND PASSED.

12.2 Bus Routes 59 and 61

Councillor Cooper advised bus routes in Cole Harbour had been adjusted to decrease the number of route 61 night runs. He stated it has been brought to his attention there is a gap in the service, between the last run by number 61 and 59, leaving a section of the Forest Hills community without coverage.

MOVED by Councillor Cooper and Deputy Mayor Greenough that a request be forwarded to Regional Operations (Halifax Transit) for report regarding the feasibility of ensuring that all route 59 trips, after route 61 finishes for the evening, covers the combined route. MOTION PUT AND PASSED.

13.1 Councillor Cunningham

Take Notice that at the next regular meeting of the Harbour East Community Council to be held on September 4, 1997, I intend to introduce a motion to amend the Rules of Procedure governing the Harbour East Community Council, Section 3, Subsection 1, to read "There shall be ten (10) regular meetings of the Community Council in each year to be held on the First Thursday of each month from September to June, inclusive.

14. PUBLIC PARTICIPATION

Mr. Jack Thomas received clarification regarding time frames for construction on the #7 Highway expressing concern with trucks using Montague Road.
