11.1 COMMITTEE OF THE WHOLE RECOMMENDATION ( Dec. 5/01)

11.1.1 Harbour Solutions Project (to be circ)

The following motion was adopted by Council:

THAT:

  1. Council accept, in principle, the recommendations of the Proposal Selection Committee of the Halifax Harbour Solutions Project, as presented to Council on October 29, 2001.
  2. Staff negotiate with the selected Proponent, Halifax Regional Environmental Partnership, for "off ramps" (HRM assuming operation of treatment plant) at six (6) and twelve (12) years in addition to the fifteen (15) and twenty (20) years already provided for in the Project Agreements.
  3. Negotiations include the terms of any amendments to the form of the Project Agreements that may be necessitated by a review of the current situation regarding available sites, financing, etc.
  4. Negotiations be completed in time for a staff recommendation to return to Council on or before February 28, 2002.

13.3 Halifax Harbour Solutions

The following motion was adopted by Council:

THAT the HRM Halifax Harbour Solutions negotiating team be composed of:

Lead: Kulvinder Dhillon, Director Public Works and Transportation Services 
Member: Daniel P. O'Halloran, President, O'Halloran Campbell Consultant's Ltd 
Member: Susan Frazer, Patterson Palmer Murphy Hill 
Ex-Officio: George McLellan, Acting Chief Administrative Officer

AND

That Halifax Regional Council recommend that if financially and technically possible, one outfall in the harbour clean up be dedicated to an alternative technology, solar aquatics.

Special Session of Council

2. HARBOUR SOLUTIONS - PRESENTATION & RECOMMENDATION

Resolution to table the report of the Harbour Solutions Selection Committee and to refer the matter to Committee of the Whole Council on Tuesday, November 6, 2001 beginning at 1:30 p.m. for further discussion was approved.

September 25, 2001

11.2.4 Herring Cove Sewer and Water

An information report from Kulvinder Dhillon, Director, Public Works and Transportation Services, dated September 24, 2001, on the above noted, was before Council.

An extract from the draft September 18, 2001 Regional Council minutes was before Council.

Councillor Adams requested information be provided in two weeks as to where HRM stands with regards to this project and the expropriation of lands and how to proceed with this process. The Councillor requested Mr. Brian Dempsey, Chair of the Ratepayers Association, be included in the discussions. Councillor Hetherington requested the report provide information on breakdown of funding for this project.

10.3.3 Councillor Adams - Herring Cove Sewer and Water

MOVED by Councillor Adams, seconded by Councillor Mosher, that the matter be referred to staff for a report for next week with respect to the costs to perform the design work for municipal water and sewer for the community of Herring Cove.

In the interim, Councillor Adams stated he would ask staff to get the information on the integration fund to find out the exact wording.

Councillor Warshick requested that the staff report also include information as to where the funding would come from for this project if it were to proceed on an early basis.

MOTION PUT AND PASSED UNANIMOUSLY.

13.5 Harbour Solutions Project

Council adopted the following In Camera recommendation: It is recommended that Halifax Regional Council:

1. Discontinue the court application for a Declaration;

2. Terminate the RFP process to meet the requirements for minimum of two proponents;

3. Advise Halifax Waterworks Group of Termination and Breach of Confidentiality clause;

4. Advise Halifax Regional Environmental Partnership of Termination and non-complete proposal effective February 19, 2001;

5. Invite both proponents to resubmit their existing proposals in our possession for evaluation consistent with the revised terms.

13.2 Community Integration Fund

The following Committee of the Whole Recommendation was adopted:

That Council adopt the General Principles - Use of Community Integration Fund attached as Schedule "A".
