9.2.1 Request for Proposal 00-127 - Archaeological Mitigation of Resources Contained Within the Proposed Site of The Halifax Wastewater Treatment Plant

Motion approved that Request for Proposal #02-127 for Archaeological Mitigation of Resources Contained Within the Proposed Site of The Halifax Wastewater Treatment Plant (Bounded by Barrington, Cornwallis and Upper Water Streets) be awarded to Cultural Resource Management Group (CRM).

11.4 HALIFAX HARBOUR SOLUTIONS PROJECT - FINANCING OPTIONS

It is recommended that:

  1. The condition precedent related to funding from the other levels of government, as currently stipulated in the Harbour Solutions Development Agreement, be lifted unconditionally and HRM proceed with the Project in its entirety;
  2. Staff be instructed to amend the current Canada/Nova Scotia Infrastructure List to reflect the remaining level of funding sought for the Harbour Solutions Project of $56M, and the program be brought back to Regional Council as part of the 2003/04 business planning process;
  3. Council approve the Harbour Solutions Project cost elements as outlined in the body of the report dated October 16, 2002;
  4. Staff be instructed to continue to investigate other federal/provincial funding opportunities and report back to Regional Council once per quarter on these and other revenue sources which might be considered or available to offset the HRM portion of the HSP and, to the extent that additional funds cannot be raised, Council from time to time shall raise the required funds through the PCC (not to exceed $0.29) to build the complete project.

Recommendation adopted. Further, Mayor Kelly requested to send a letter to former Councillor Larry Uteck in recognition of his services with regards to the Halifax Harbour clean up.

(Note: PCC = Pollution Control Charge. $0.29 is per cubic meter)

11.1 Halifax Harbour Solutions

The following In Camera recommendation was approved:

That Council authorize the Mayor to proceed with the signing of the contract and that staff come back at the earliest Committee of the Whole meeting to discuss funding options.

11.2 Harbour Solutions Project

That Regional Council reaffirm its commitment to the Halifax Harbour Solutions project.

12.5 Contractual Matter - Halifax Harbour Solutions Project - Contract Negotiations

The following recommendation was approved.

That Halifax Regional Council:

1. Ratify the costs to complete the negotiation process with the team of Daniel P. O'Halloran, President, O'Halloran Campbell Consultants Ltd., Susan Frazer, Patterson Palmer, and Eric Schibler, KPMG at a cost not to exceed the amount stipulated in the Discussion portion of this report; and

2. This report not be released to the public until Council approves the total Harbour Solutions Project costs in early September 2002.

13.2 Harbour Solutions

It is recommended that, Council approve the Halifax Harbour Solutions Project Agreements as outlined;

WHEREAS it is proposed that the Halifax Regional Municipality ("HRM") enter into seven agreements with the Halifax Regional Environmental Partnership and others with respect to the Halifax Harbour Solutions Project, namely a Development Agreement, Halifax Operating and Maintenance Agreement, Halifax License, Dartmouth Operating and Maintenance Agreement and Herring Cove License (collectively, the "Project Agreements");

AND WHEREAS on May 7, 2002, Council agreed in principle to enter into the Project Agreements substantially in form of the draft agreements dated April 10, 2002 reviewed by Council, subject to the following conditions precedent:

  1. Advice from the Federal Government and the Province of Nova Scotia that HRM's requests for funding have been approved; and
  2. Receipt of a decision from the Responsible Authorities that the environmental effects of the Project are acceptable under the Canadian Environmental Assessment Act.

AND WHEREAS Council has received and reviewed revised drafts of the Project Agreements (drafts dated June 28, 2002) which incorporate the conditions precedent;

NOW THEREFORE BE IT RESOLVED as a resolution of Council that HRM enter in Project Agreements for the Halifax Harbour Solutions Project substantially in the form of the June 28, 2002 drafts presented to and reviewed by Council.

Motion Passed.

6. MOTIONS OF RECONSIDERATION

6.1 Councillor Walker - Halifax Harbour Solutions

The Motion of Reconsideration was defeated. Therefore the original motion adopted on May 7, 2002 stands.

13.3 Legal Matter: Halifax Harbour Solutions

The following In Camera recommendation was adopted by Council:

WHEREAS it is proposed that the Halifax Regional Municipality ("HRM") enter into seven (7) agreements with the Halifax Regional Environmental partnership et al with respect to the Halifax Harbour Solutions Project, namely a Development Agreement, Halifax Operating and Maintenance Agreement, Halifax License, Dartmouth Operating and Maintenance Agreement, Dartmouth License, Herring Cove Operating and Maintenance Agreement and Herring Cove License (collectively, the "Project Agreements");

AND WHEREAS Council has reviewed drafts dated April 10, 2002 of the Development Agreement, the Halifax Operating Agreement and the Halifax License;

AND WHEREAS HRM has made a request to the Government of Canada and to the Province of Nova Scotia for funding assistance in order to implement the Halifax Harbour Solutions Project.

NOW THEREFORE BE IT RESOLVED as a Resolution of Council that:

1. HRM agree in principle to enter into the Project Agreements with Halifax Regional Environmental Partnership, Suez, Onedo North America Inc., United Water Resources Inc. and United Water Services Canada LP substantially in the form of the draft Project Agreements presented to and reviewed by Council, which Projects Agreements shall be subject to the following conditions precedent:

  1. advice from the Federal Government and the Province of Nova Scotia that its request for funding has been approved; and
  2. the receipt of a decision from the Responsible Authorities that the environmental effects of the project are acceptable under the Canadian Environmental Assessment Act.

2. Before they are executed on behalf of HRM, the final form of the Project Agreements (including all Schedules) be presented to Council together with a summary of all material changes made from the April 10, 2002 drafts, which changes shall be generally consistent with the RFP and with HREP's Proposal.

However, Councillor Walker served a NOTICE OF MOTION OF RECONSIDERATION, seconded by Councillor Sloane, of this item for May 14, 2002.

That Halifax Regional Council confirm the HRM-owned site on the corner of Cornwallis and Barrington Streets as the site for the sewage treatment plant in Halifax.

8.2 Ecological Wastewater Treatment / Solar Aquatics TM (supp report) 
(deferred from Feb. 5, 2002)

The following motions were adopted by Council:

That Halifax Regional Council not dedicate an outfall in the Harbour Solutions project to Solar Aquatics TM technology.

That Halifax Regional Council consider the use of Solar Aquatics TM technology in the future in a full cost/performance comparison with other innovative and conventional systems for a small plant, serving a small community.

13.2 Halifax Harbour Solutions Project

The following In Camera recommendation was adopted by Council:

That Council endorse the following with regard to restrictions on Communications during the negotiating period for the Halifax Harbour Solutions Project:

HRM is committed to the philosophy of transparency and to providing interested members of the public with relevant information concerning the current status of its plans for the Halifax Harbour Solutions Project ("Project"). HRM is anxious to ensure that, during the period it is negotiating with Halifax Regional Environment Partnership ("HREP") in an effort to reach an agreement regarding HREP 's participation in the Project, nothing be done which would compromise the integrity of the negotiating process or HRM's position during the negotiations.

HRM has concluded that, during the period it is negotiating with HREP, the following guidelines and restrictions be observed:

  1. HRM and HREP cooperate in implementing a public information program aimed at providing interested members of the public with general information regarding the Project. The public information program should include public information sessions and access to information on HRM's website. The HRM negotiating team shall coordinate such activities on behalf of HRM.
  2. All communications with the public regarding the Project, whether by HRM or HREP, shall be in general in nature and in no event shall either HRM or HREP make any comments to the media or in the public domain regarding matters which are subject to negotiations between the parties. Wherever possible, each of HRM and HREP shall seek the approval of the other whenever making any written public statement regarding the Project.
  3. HREP shall direct all questions or communications regarding matters which are the subject of negotiation to or at the direction of HRM's negotiating team.
  4. HREP shall be requested to ensure that, in any communications with any member of Council, HREP shall not refer to any matter which is the subject of negotiation between HREP and HRM.
  5. All verbal communications between HREP and members of Council on this subject be held in the presence of a member of the HRM negotiating team or a nominee thereof.
  6. There shall be no verbal communications between HWG and members of Council on this subject. All written communications from HWG shall be referred to the Director of Public Works and Transportation.
